Fighting for the Rights of the Injured in West Tennessee

No matter how many preventative measures we take to protect ourselves from accidents – from wearing our seat belts in the car to following protocol when operating machinery at work – we cannot control someone else’s negligence or prevent other people’s mistakes. A negligent driver, a defective product, an unmarked slippery floor – these are all just far enough out of our control that some accidents cannot be avoided.

If you have been injured in an accident caused by someone else’s action or lack thereof, you deserve aggressive representation from an attorney who can fight for your rights. You deserve representation from Snider & Horner, PLLC.

The Statute of Limitations in Tennessee

The statute of limitations in Tennessee is one of the shortest across the U.S., being only one year. This means that you have one year from the date of your injury to file a personal injury claim. There are three main exceptions to this. The first being if an injury victim is under the age of 18 or has been determined "adjudicated incompetent" by the court. Adjudicated Incompetent means mentally incompetent at the time. In these cases, the individual has one year from their 18th birthday or from their date of restored competence to file a claim.

The second exception is if the negligent party resides or is absent for a prolong period from the state of Tennessee. Their date of absence will most likely not be counted in the one year time frame. The last exception is if the negligent party has criminal charges brought against them. In this case they statute of limitations would extent to two years.

Why You Need an Attorney

In the immediate aftermath of an accident, you might not be thinking about hiring an attorney. Accident scenes can be overwhelming and confusing, and you are probably in shock. After taking the time to take notes about the incident and seek medical attention, we highly recommend that you speak with an attorney to protect your rights from the start.

Without an attorney, you will be left to face powerful insurance companies alone. Remember that the insurance company does not have your best interests in mind – they will do whatever it takes to mitigate their liability and to reduce the compensation you receive.

With Snider & Horner, PLLC on your side, however, you can fight for justice and seek a favorable resolution. Our West Tennessee personal injury attorneys devote their work to helping you get the full compensation to which you are entitled.
